Preamble

 THIS AGREEMENT, by and between the member schools of SECTION VI of the NEW YORK STATE PUBLIC HIGH SCHOOL ATHLETIC ASSOCIATION, INC., (NYSPHSAA) with an office for the transaction of business at  Erie I BOCES, 355 Harlem Rd., West Seneca, NY 14224, hereinafter referred to as “SECTION VI” and the WESTERN NEW YORK SPORTS OFFICIALS, hereinafter referred to as “OFFICIALS”.

 WHEREAS, the Interscholastic athletic program is an integral part of the educational curriculum conducted by school authorities under rules adapted for the health and safety of the students and; WHEREAS, the details of game administration for interscholastic contests are the responsibility of the school authorities and;

 WHEREAS, it is essential that the officiating of games shall be performed as a part of the educational program of the school and;

 WHEREAS, the parties hereto wish to enter into an agreement in regard to all aspects of officiating for SECTION VI sponsored athletic events, and;

 WHEREAS, the parties hereto agree that the giving and the acceptance of an official’s assignment is an agreement between the individual school and the official to the extent that the official and the school will fulfill the terms of said agreement unless unusual and unforeseen circumstances prevent the official from fulfilling the agreement or prevent the school from conducting the scheduled event, and;

 NOW, THEREFORE, it is mutually agreed as follows: 1. This Agreement shall be effective beginning September 1, 2013 and shall terminate August          31, 2018. 2. The parties hereto agree to the compensation for officials as listed in the “officials fee        schedule” for the term of this Agreement 3. All parties subject to this contract will adhere to all provisions of this agreement

 

3-Blocking & Evaluation of Officials

 1. A five member committee comprised of (2) WNYSO members, (2) Section VI members, and a mutually agreed upon impartial member will develop an official evaluation tool during the 20152016 school year that will be implemented for the 2016-2017 school year. 2. Blocking of officials will take place on a yearly basis by the schools with removal of the blocks done yearly by each organization’s sub-assigner.  Blocks must be submitted to the league assigners by June 15 for Fall sports, October 15 for winter sports, and February 15 for Spring sports. Financial Issues

 1. The compensation of officials is the responsibility of the host school or the section office. 2. A full fee will be paid to working official(s) when a contest starts but is not completed. 3. If exhausted rosters force any Varsity or Junior Varsity contest to be played without a full contingent of officials, the working official will be compensated an extra 50% of the scheduled fee. If exhausted rosters force any modified contests to be played without a full contingent, then an additional $10 will be added to the working official’s scheduled fee.  Adjusted compensation to be made by the host school.  Proper notification of exhausted rosters should be made to all involved parties. 4. Form X must be submitted to the Section office by the assigned official(s) within seven calendar days of contest.  5. Officials’ organizations OBRs need to receive documentation from the Section office within three business days, of receipt of Form X. 6. Official works shorthanded because of an assigned partners absenteeism, the home school will pay the working official(s) one full fee.  All extra payment will be determined via the Form ‘X’ procedure. 7. Official misses an assignment for an invalid reason:  A full contest fee will be assessed and  collected by the official’s board.  One half of all fines will be forwarded to the Section’s ‘Form X’ fund at seasons end.  The validity will be determined jointly by the Section Executive Director and the involved OBR. Personal illness or injury to official or immediate family and unavoidable work related responsibilities are examples of valid reasons. 8. If officials are scheduled for two games at the same location (ex. A doubleheader baseball game) and the coach(es) decide not  to play game two because of non-weather related issues, then the officials will be compensated full fee for both contests. The officials must file a Form X. 9. Official is asked to cross territorial boundaries for the purpose of fulfilling the obligations of a neighboring unit; he/she will receive a full contest fee from the home school, and a $20.00 mileage premium from the Officials’ Form X Fund.  The fee will be automatically awarded with proper notification of the LAA involved. (Please see page 8, Geographic Area) 10. When involved schools are not prepared to play at the scheduled starting time officials will be compensated one full fee each.  In addition, each working official will receive extra payments, at all levels, determined via the Form ’X’  procedure using the following schedule:               15 minutes or less               no fee                16 minutes  - 30 minutes   $15.00              31 minutes  - 45 minutes   $25.00              60 minutes  or longer         $40.00 11. All compensation disputes not covered by this article will be resolved via the Form 'X’ procedure. 12. Once a contest has been assigned, if the host school changes to a scrimmage, officials shall be paid the contest fee. 13. Invoices sent from the Section VI office to officials’ organizations, must be done within 30 days of the completion of Sectional final in that sport. 14. Competing schools and involved official(s) are on site but contest does not begin because of unforeseen circumstances (e.g.  Weather, power outage, etc.), official(s) will be compensated at ½ fee.

15. Same day contests, which are moved to another location, due to non-weather related issues, and that location is covered by another officials’ organization, the officials originally scheduled will be compensated full game fee.  16. In a contest where a school requests the maximum number of officials and that contest is moved to another school’s site which does not require the same amount of officials, the original site school will be responsible for payment of officials (ON A SAME DAY CHANGE). 17. A contest is posted on ArbiterSports and one school fails to show.  The working official(s) will be compensated one full fee according to that respective sport’s fee schedule, providing they are on site. 18. When assigning errors occur, officials will be compensated at ½ base fee. 19. Officials who leave a contest for an invalid reason will not be compensated. Validity will be determined jointly by the Section Executive Director and the involved OBR. 20. When a valid same day cancellation occurs, officials will not be compensated.  Every effort to assign them to the rescheduled contest or another at the same level will be made. When an invalid same day cancellation occurs, officials will be compensated one full fee.   Validity will be determined jointly by the Section Executive Director and the involved OBR.  Outside groups using the facility or unscheduled social functions replacing scheduled athletic events will be considered invalid. 21. If an official is asked to cross territorial boundaries for the purpose of fulfilling a post season (sectional) assignment, a $20.00 mileage premium will be added directly to his / her fee. 22. If an official is given multiple assignments at one site (original schedule), the fee is full for the highest level contest and 2/3 for the second and subsequent assignments rounded up to the nearest dollar, unless a specific fee already appears in the fee schedule.  Multiple assignments are defined as same sport, back-to-back, at the same facility with a reasonable warm-up period prior to contest two, and subsequent contests (exception dual meet tournament). Updated 7/19/16 23. Pre-season Scrimmage fees, prior to first contest of host school, ALL SPORTS for the duration of this contract:  Varsity Level $40.00, Junior Varsity/Modified/Freshman Level $30.00.  Fees for scrimmages held during the regular season are contest fee rates. 24. All tournament fees, for all sports, are the responsibility of the host school. 25. Member schools that host contests with neighboring sections, or schools not regulated by this agreement will be held responsible for any contract violations involving Section VI officials. 26. Fee schedules for all events that are altered in length of time / working conditions by a change in High School Federation rules will be subject to review by the WNYSO and Section VI. 27. For the 2015-2016 school year, a study between Section 6 and the WNYSO will take       place regarding the implementation for the 2016-2017 school year of centralized payment of officials. 28. When assigned official(s) are not prepared to start at the assigned starting time, compensation should be reduced using the following schedule:               15 minutes or less               no penalty              16 minutes  - 30 minutes     25%              31 minutes  - 45 minutes     50%              46 minutes  - 60 minutes     75%              61 minutes  or longer           no compensation 29. All fees should be paid within 30 business days of completed contest.
